Background
Dos Republicas began operating in July 2015 after it received a permit in 2013 from the Texas Railroad Commission to mine 2.8 million tons per year from an expanded 6,346-acre site. The coal from the mine is too low of a grade to be used in the U.S., so it is exported to Mexico.[1]
Maverick County, the city of Eagle Pass and local residents brought a lawsuit against the Railroad Commission of Texas for their 2013 permit to Dos Republicas. The Texas Supreme Court announced they would not hear a challenge to the coal mine in 2017.[2]
In July 2016 the Texas Commission on Environmental Quality’s three-member board voted to both renew and expand a wastewater permit for the mine. This occurred in the face of extensive community backlash, which has been fighting against permitting the mine for years.[3] The expansion would add 25,000 of potential area to the mine's existing 6,346 acres.[4]
In December 2018, the mine applied for a "renewal and revision" of their mining permit, which would extend the mine's operations by 5 years.[5]
But in July 2020, Dos Republicas Coal Partnership announced that they would no longer be pursuing the extended permit, and instead would be seeking a Reclamation Only Permit. This means that the mine would effectively shut down and reclamation of the land used for the coal mine back to its natural habitat would begin. The news was announced in light of a contract cancellation with a power plant in Mexico.[6]
