Violations
According to the sanitary rules of Kazakhstan, cement production belongs to class 1 of hazardous enterprises and the sanitary protection zone should be no less than 1000 meters. The distance between the nearest house and the plant is no more than 500 meters.[1]
Gezhouba Shieli Cement LLP is included in the List of 50 companies in Kazakhstan with the highest harmful emissions.[1]
The lawsuit
Four families of Kodamanov village sued the company for air pollution and damages caused to their health and livelihoods. Residents of the village of Kodamanov in the Shieli district have been fighting for their health since 2019. In 2021, Radio Azattyk wrote about locals who were forced to move due to constant dust, poor health, smoke and smell.[2]
The Sanitary and Epidemiological Control Department issued that the activities of the cement plant in the village of Kodamanov, Shieli District, do not have a negative impact on the health of the population. Residents did not agree with this and filed a lawsuit. The first instance supported the residents and recognized the conclusion of the department as illegal, to which the cement plant filed an appeal in response.[2]
In 2021, the capital court upheld the authorities' right not to provide Almaty-based environmental activists with official documents related to the construction of the cement plant, including an environmental impact assessment.[1]
In October 2024, the panel of the judges concluded that the cement plant grossly violated the requirements for the sanitary protection zone. The panel of judges left the decision of the court of first instance unchanged and the company's appeal was dismissed. However, the court's decision has not yet entered into legal force and the case has now been referred to the court of cassation for consideration.[2]
