Violations

The plant has been repeatedly fined for violating environmental legislation - in 2005, the fine was 9 million tenge, a year later - already 15 million.[1]

In 2007, the inspection found violations in harmful emissions, waste management, and groundwater deposit use.

In 2008 the plant refused to voluntarily pay 52 million tenge in fines, and so the environmentalists filed a lawsuit in the South Kazakhstan Specialized Interdistrict Economic Court. The legal battle lasted almost six months. The court ruling was in favor of the environmentalists, but the plant's management will most likely challenge it in a higher court. It is unclear if the plant eventually paid the fine.[2]

However, financial penalties did not course correct the plant's operations, since the plant remained profitable, including with minor penalties.[3] The owner at the time was Italcementi Groupe.[3]

In 2012, the plant was fined 43 million tenge.[4]

In 2013, the court collected from JSC Shymkentcement in damages in the amount of 184.5 million tenge and a state fee in the amount of 5.5 million tenge.[5]

In 2016, the plant changed ownership from Italcementi Groupe to HeidelbergCement due to the latter absorbing the former.[2]
